Ministry of Foreign Affairs of Ukraine expresses its strong protest against the decision taken by the Yessentuki city court to extend the detention of citizen of Ukraine Stanislav Klyh until 21 October 2015.
Groundless and unlawful judgment of the court is another proof of the unwillingness of the Russian Federation to adhere to the provisions set forth in the Package of Measures for the Implementation of the Minsk agreements, which envisage the release of all hostages and other unlawfully detained persons on “all for all” basis.
At the same time, despite the assurances of the MFA of the Russian Federation, as given last year, that the investigative authorities will permit consular officers of Ukraine to visit the arrested, the Russian competent authorities continue to obstruct the possibility of any meetings with S.Klyh.
The above mentioned actions are a gross violation by the Russian side of the rights of citizens of Ukraine as well as the rights of consular officers of Ukraine to access any detained nationals under Article 13 of the Consular Convention between Ukraine and the Russian Federation of 15 January 1993.
We demand to ensure an objective and impartial proceeding for Stanislav Klyh, to provide official information on the place and conditions of his detention and the state of his health, to allow immediate access of consular officers of Ukraine to the arrested in accordance with the international legal commitments of the Russian Federation and bring to justice those responsible for violating them.
MFA of Ukraine also states that the violations of human rights of Ukrainian citizens in the territory of the Russian Federation have acquired systematic and discriminatory character. At the same time, the rights of consular officers of Ukraine are grossly violated that makes it impossible to properly carry out consular functions in the territory of the Russian Federation. Acting this way, the Russian side should be aware that under these circumstances, Ukraine reserves the right to apply adequate response measures.
